Aquafixx Plumbing and HeatingThese Terms and Conditions apply whenever Aquafixx Plumbing and Heating Limited ("we", "us", "our") carries out plumbing or heating work for you ("you", "your"), and to your use of our website, aquafixx.co.uk. Please read them alongside any quote we give you. By asking us to go ahead with work, you agree to these Terms.

2. About These Terms
These Terms apply whenever you ask us to carry out plumbing or heating work, whether you contact us by phone, email, through our website, or in person. They apply alongside any written quote or job description we give you; if there's a conflict between the two for a specific job, the quote takes priority on the details of that job.By asking us to go ahead with work, you agree to these Terms. Nothing in these Terms affects your statutory rights as a consumer.
3. Quotations and Estimates
Where we give you a fixed quote, the price won't change unless the scope of work changes or we find something during the job that we couldn't reasonably have known about in advance (see clause 5.4). Where we give you an estimate rather than a fixed quote, this is our best assessment of likely cost, and the final price may vary depending on what we find once work starts.We'll always tell you before carrying out any extra work that increases the price, except in a genuine emergency where delaying would put people or property at risk. Quotes are normally valid for 30 days from the date given, after which prices may need to be revised.
4. Your Contract With Us.
A contract between us is formed when you accept a quote, in writing, by email, or by telling us to go ahead, or, where no formal quote was given, when we agree to carry out the work and you confirm you want us to proceed.If you're a consumer and the contract was agreed somewhere other than our own premises (for example over the phone, online, or at your home), it's also subject to your cancellation rights in clause 7.5. Carrying Out the Work
5.1 Access.
You'll need to give us reasonable access to the property and the work area at the agreed time. If we can't gain access, or the site isn't ready for us to start, we may need to rearrange the visit and additional charges may apply.
5.2 Your responsibilities.
Please tell us about anything that might affect the job before we start, for example asbestos, structural issues, or restricted access, and move or protect any furniture, flooring or belongings you'd like kept clear of the work area.
5.3 Materials.
Unless we agree otherwise, we'll supply the materials needed for the job and these are included in the price. If you'd prefer to supply your own materials, we're not responsible for their quality or suitability, though we'll fit them with reasonable care and skill.
5.4 Unforeseen issues and variations.
Older properties, and pipework or wiring that's already in place, sometimes hide problems that aren't visible until work starts. If we discover something like this, we'll stop, explain the issue, and agree a revised price or approach with you before continuing, except where continuing is necessary to avoid immediate danger or further damage.
5.5 Subcontractors.
We may use suitably qualified subcontractors or specialist engineers to carry out all or part of the work. We remain responsible for work carried out on our behalf.
6. Price and Payment
Prices do not include VAT unless stated otherwise. We may ask for a deposit before starting work, and/or staged payments for larger jobs, as set out in your quote. Payment is due on completion unless we agree otherwise in writing.We accept payment by bank transfer, card or cash. We don't store full card details; card payments are processed by our payment provider.If payment is late, we may charge interest on the overdue amount, in line with the Late Payment of Commercial Debts (Interest) Act 1998 for business customers, or at a reasonable rate we'll confirm with you for consumer customers.
7. Your Right to Cancel
If you're a consumer and our contract with you was agreed away from our premises (for example at your home, over the phone, or online), you normally have 14 days from the date of the contract to cancel, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.To cancel, tell us in writing that you wish to cancel, for example by WhatsApp message or email.If you'd like us to start work within the 14 day period, we'll ask you to confirm this in writing first. If you then cancel after work has started, you'll be responsible for paying for the work carried out and any materials used up to the point you told us you were cancelling, not the full price. Once the work has been completed in full, having started at your request within the 14 days and with your acknowledgment that you'd lose the right to cancel once finished, this cancellation right no longer applies.
8. Cancellation by Us
We may cancel or postpone a booking if, for example, we're unable to safely or lawfully carry out the work, you don't provide safe access, or payment isn't made as agreed. Where we cancel through no fault of yours, we'll refund any amount you've already paid for work not yet carried out.
9. Guarantees on Our Work
We guarantee our workmanship for 12 months from the date the job is completed. If a defect appears in that time that's caused by our work, contact us and we'll put it right at no extra charge. This doesn't cover general wear and tear, misuse, or work carried out by someone else afterward.This guarantee covers our workmanship only. It doesn't cover faults with products or parts we've installed, even if we supplied them: those are covered by the manufacturer's own warranty, details of which we'll pass on to you, and any claim for a faulty product should be made under that warranty rather than to us.This guarantee is in addition to, and doesn't affect, your statutory rights under the Consumer Rights Act 2015.
10. Regulatory Compliance
Where work involves gas appliances or installations, it will only be carried out by an engineer registered with Gas Safe Register (our Gas Safe registration number is 940210); you can check this at any time at gassaferegister.co.uk.Where work involves electrical installations, it will be carried out in line with Part P of the Building Regulations by an appropriately qualified person. We'll provide any certificates, building control notifications, or safety records required by law once the work is complete.
11. Our Liability and Insurance
We hold public liability insurance of at least £1 million (details available on request). We're responsible for loss or damage you suffer that's a foreseeable result of our breaching these Terms or carrying out work without reasonable care and skill, but we're not responsible for losses that aren't a foreseeable result of our actions, or for problems caused by pre-existing faults we weren't asked to fix.Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't legally be limited or excluded, and nothing in these Terms affects your rights under the Consumer Rights Act 2015.
12. Making Good
If carrying out the work means we need to lift flooring, cut into walls, or otherwise disturb fixtures and finishes, we'll let you know before we start so you're happy to go ahead on that basis. We'll leave the work area in a safe, workmanlike condition once we're done, but redecoration, refitting of flooring, and cosmetic finishing aren't included in our price. You may need to arrange these separately with someone else, unless we've specifically agreed and priced them into your quote.
13. Delays and Events Beyond Our Control
We'll always try to keep to agreed dates and times, but occasionally things outside our control, such as parts availability, weather, or an emergency call-out elsewhere, may cause a delay. We'll let you know as soon as we can and agree a new time with you. We're not liable for delay caused by circumstances beyond our reasonable control.
14. Complaints
If you're unhappy with our work, please contact us using the details in clause 1 as soon as possible so we can put things right. Our Complaints Policy, which explains how we handle and respond to complaints and how long it takes, is available on our website and on request.
15. Use of Our Website
Our website is provided for general information about our services. While we try to keep it accurate and up to date, we don't guarantee it's complete or error-free, and it doesn't form part of any contract for work unless we confirm otherwise in writing.All content on the site (text, images and logos) belongs to us or our licensors and shouldn't be copied or reused without our permission. Our website may link to third-party websites; we're not responsible for their content or privacy practices.
16. Data Protection
We only use your personal information as set out in our Privacy & Cookies Policy, available on our website, which explains what we collect, why, and your rights.
17. Other Important Terms
If any part of these Terms is found to be unenforceable, the rest will continue to apply. If we don't immediately insist that you do anything you're required to do under these Terms, that won't mean we've waived our rights.We may update these Terms from time to time; the version in place when you accept a quote is the one that applies to that job. These Terms are between you and us; no one else has any right to enforce them, unless the law says otherwise.1
8. Governing Law
These Terms are governed by the law of England and Wales, and any dispute will be dealt with by the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also be able to bring proceedings in your own local courts.
